The conditions of use (as well as the information and policies of NEREIDES DISTRIBUTION on the Site and any other document mentioned in these conditions of use, collectively “Terms of Use”) define the legal conditions which apply to your access and to your use of the Site www.lesnereides.com  (hereinafter the “Site”) published by NEREIDES DISTRIBUTION, a simplified joint stock company registered in the Paris (France) Trade and Companies Register under number 400 260 386 (SIREN number), with VAT number FR 314 0026 0386, whose head office is at 3 rue Barbette 75 003 Paris, France, and whose main place of business is at 29 rue des Petites Ecuries 75 010 Paris, France (“Les Néréides”), which designs and markets Les Néréides and N2 by Les Néréides products worldwide (the “Product(s)”).

The Publication Director is Mr. Pier Paolo AMADDEO, General Director of Les Néréides.

• The Site is hosted by [Shopify International Limited] whose registered office is 2nd Floor, Victoria Buildings 1-2, Haddington Road, Dublin,4, D04 XN32, Ireland.
• The design of the Site is carried out by the Antadis digital agency whose head office is 1 rue de Clairefontaine 78120 RAMBOUILLET, (Tel: 06 14 30 15 65).

The Site is subject to French law. The French courts have sole jurisdiction over any dispute relating to access to or use of the Site, with the exception of the right, as a consumer, to be sued or to take legal action before the court of his/her place of residence.

Please note that your purchase of any of the Products offered on the Site is also subject to the Terms of Sale, available here and by placing an order for any Product you agree to be bound by them. The use of your personal information submitted on or through the Site is governed by our Privacy and Cookies Policy, available here.

1. OPERATION OF THE SITE

The Site belongs to Les Néréides and is open to any user of this network.

You are authorized to use the Site and its content for your personal, non-commercial use only and always in accordance with these Terms of Use and applicable laws and regulations.

It is your responsibility to ensure that your equipment (desktop computer, laptop, notebook, tablet or any other mobile device) meets all the technical specifications necessary to allow you, on the one hand, to access and use the Site and, on the other hand, is compatible with the Site.

We may, from time to time, provide access to certain features, portions or content of the Site, or the entire Site, only to users who have registered with us. For example, you may be required to register and/or open a personal account by inserting your data in order to have access to reserved spaces and content, be included in specific mailing lists relating to Products and commercial initiatives, participate in marketing initiatives promoted by Les Néréides, create personalized lists of favorite Products and purchase Products online.

You are responsible for all activities that occur under your login credentials and shall notify us immediately of any unauthorized use or other breach of security of which you become aware.

We reserve the right to disable any login credentials, at any time, if (i) we reasonably believe that you are using your login credentials in violation of these Terms of Use, (ii) we reasonably believe that a third party is using your login ID without your consent, or (iii) we reasonably deem it necessary to terminate or suspend your account for security or maintenance purposes.

The Products displayed on the Site are owned and sold by Les Néréides. Les Néréides strives to be as precise as possible in the description of the Products. However, we cannot guarantee that descriptions are completely complete or error-free. If you have any doubts about the description of a Product, we recommend that you contact us before placing an order.

Les Néréides may, without notice, modify or delete, at its sole discretion, temporarily or permanently, certain Products and/or services, as well as the associated features and specifications, or make changes to the applicable prices.

1. INTELLECTUAL PROPERTY

The Les Néréides and N2 figurative and non-figurative trademarks and in general all illustrations, images and logos registered or not which appear on this Site, are and will remain the exclusive property of Les Néréides.

The contents of the Site are the exclusive property of Les Néréides, the only one authorized to use the intellectual property rights and related personality rights, in particular trademarks, models, copyright, and image rights, on an original basis or by effect of express authorization.

Nothing contained on the Site should be construed as granting any license or right to use any content or other material displayed on the Site without the written permission of Les Néréides.

All content may be protected by national laws and international intellectual property treaty provisions, including, but not limited to, copyright, patent and trademark laws.

1. CONTENT AND LIABILITY

Les Néréides makes its best efforts to ensure the reliability, accuracy and updating of the information provided on the Site.

However, Les Néréides does not guarantee in any way the precision or completeness of the information made available on the Site; and more generally for any damage, direct or indirect, whatever the causes, origins, nature or consequences, caused due to anyone's access to the Site or the inability to access it, as well as that the use of the Site and/or the credit given to any information coming directly or indirectly from the latter.

Les Néréides reserves the right to modify or correct the content of the documents published on its Site, at any time and without notice.

The creation of a hypertext link to the Site can only be done with the express, prior written authorization of Les Néréides. Les Néréides declines all responsibility regarding the content, advertising, Products or services available on or from sites linked by a hypertext link to its Site. The Site may include links to other websites or other Internet sources.

To the extent that Les Néréides cannot control these external sites and sources, it cannot be held responsible for the provision of these external sites and sources, and cannot bear any responsibility for the content, advertising, products, services or any other material available on or from these sites or external sources. In addition, Les Néréides cannot be held responsible for any proven or alleged damage or loss resulting from or in connection with the use or the fact of having trusted the content, goods, or services available on these external sites or sources.

The Site may install a “cookie” on the user’s computer which will allow them to be identified. Please note that the user can oppose the recording of “cookies” by configuring their browser to this effect.

Les Néréides implements means intended to ensure the security of files created from personal data collected on the Site. However, Les Néréides does not control the risks linked to the operation of the Internet and draws users' attention to the existence of possible risks in terms of confidentiality of data passing via this network and declines all responsibility attached to these risks.

We advise you not to send via the Site any content, material, or information that you consider confidential or proprietary.

1. GENERAL PROVISIONS

You shall not transfer or assign any or all of the rights granted to you or obligations you have under these Terms of Use.

If any provision of these Terms of Use is found to be unenforceable, all other provisions will not be affected. And if Les Néréides fails to enforce one of its rights or a provision of these Terms of Use, this does not result in a waiver of this right or this provision.

These Terms of Use may only be modified with the express written consent of Les Néréides.

These Terms of Use and any document expressly mentioned therein represent the entire agreement between the user and Les Néréides with respect to their subject matter.
